If you’re considering a career in private security, one of the most common questions you might ask is: Can a security guard make an arrest in California? The answer is yes—but only under specific circumstances, and it’s important to understand the law before acting.
In California, security guards do not have the same powers as peace officers. Instead, their authority comes from the same law that applies to private citizens: California Penal Code § 837 (PC 837).
This law allows any private person—including a licensed security guard—to make what’s called a “citizen’s arrest” if:
A public offense (misdemeanor or felony) is committed in their presence
A felony has actually been committed, and they have reasonable cause to believe the person committed it
It’s critical to understand that a security guard is not a police officer. While guards can arrest individuals under PC 837, they must immediately notify law enforcement so that peace officers can take custody of the person. Acting outside of these legal boundaries can expose both the guard and their employer to civil or criminal liability.
To work as a professional security guard in California, you must obtain a Guard Card license issued by the Bureau of Security and Investigative Services (BSIS).
The licensing process includes:
8 Hours of Initial Training – “Powers to Arrest” and “Appropriate Use of Force.”
32 Hours of Continued Training – 16 hours mandatory + 16 hours elective within the first 6 months of employment.
Annual Refresher Training – 8 hours each year to remain compliant.
Once licensed, you may also pursue BSIS firearm, baton, pepper spray, or CPR certifications depending on your employer’s requirements.
